The following is a terms and conditions applicable to TheHomevision.com here in refer to as "The Homevision", "we" or "us" Homeowners herein refer to as "Homeowners" and Professionals, Contractors, Suppliers herein refer to as "Members" and Visitors herein refer to as "Visitors". Homeowners and Members and Visitors that are currently using or planning to use The Homevision services are adults and over 18 years old, they understand and agree to the following terms and conditions. If you do not understand or agree with the following terms and conditions please do not use this site.
1. Who we are.
The Homevision is a referral service organization connecting Homeowners to our network Members who specializes in home improvement projects so the Homeowners can get their home improvement projects done .
2. Who we are not.
The Homevision is not acting as a investment advisor, or supervisor and have no control over the Members pricing and/or terms.
3. Endorsement.
The Homevision does not promote, indorse or recommends any particular Members expertise or skills. It is up to Homeowners to decide on which Members they like to hire to help them with their renovation projects. References to any specific services or trademark is not controlled by The Homevision and does not constitute or imply its association, endorsement or recommendation.
4. Verification.
The Homevision verifies all Members information such as licensing , insurance and bonding prior to them joining the network, however The Homevision does not: guarantee or warranty that:
a. All Homeowners will be connected to Members.
b. All Members will show up at the schedule appointment with the Homeowners.
c. All Members have all materials and supplies available to finish the projects at all times.
d. All Members will comply with their contractual agreement with the Homeowners.
e. How many Members will provide estimates to Homeowners.
f. Any contractual or financial relationship between Homeowners and Members.
g. The third party services on our web site, their accuracy or the reliability of their information's obtained will meet or surpass the Homeowners, Members or Visitors requirements.
h. The Homevision services is available in all states or regions.
i. Regarding any functions contained in the site, materials will be uninterrupted or error-free or that errors will be detected or corrected.
5. Distribution.
The Homevision will distribute referrals as they come to our web site on a daily basis. The Homevision will do the best to connect Homeowners to Members, however we can not guarantee or warranty the accuracy of the information that comes to our web site.
6. Indemnification.
Members agree to maintain the proper licensing for a trade they service, bonding, carry a minimum of $1,000,000.00 in general liability insurance and workman's compensation insurance or a waiver thereof (if self employed) as needed for each project performed for the Homeowners. Members also agree to inform The Homevision of any changes in their licensing, bonding or insurance so The Homevision can update Members information.
7. Hold Harmless.
Homeowners and Members agree by using our services to hold The Homevision harmless of any claims, demands and damages of any kind known or unknown arising out of any disputes between them. The Homevision will not be liable for any damages, delays in renovation, disputes and negligence arising from a contractual or verbal relationship between Members and Homeowners.
8. Membership.
For a Members to fully benefit from The Homevision network and realize all the potential, we require a minimum membership of 90 days initially. Upon joining the network, there is a $99.00 non refundable activation and account set up fee. Members will start receiving appointments once their account is active. After the 90 days period, once Members decide to become a full member of The Homevision you will enroll to a one year membership agreement. However if you decide to cancel prior to 90 days there will be a $99.00 early termination fee.
9. Photography.
To keep our web site up to date by informing Homeowners and Members of new trends and renovation projects, Homeowners and Members agree herein upon request of The Homevision either to send us photography of the current renovation projects or allow our own photographer to take a picture of before, after and/or during projects to share with other Homeowners and Members on our web site. For the privacy of our Homeowners The Homevision does not disclose the name or location of the Homeowners project on our web site pictures and photography.
10. Dispute.
This agreement is binding on the heirs, successors and or assignee of the parties herein. In the event of any disputes between the parties herein the prevailing party shall pay all the court costs, reasonable attorneys fees incurred in a said action. All parties agree that this agreement shall be enforced accordance with the law of State of Virginia. If any arbitration or litigation becomes necessary, the parties agree to litigate or mediate this matter in the State of Virginia, County of Fairfax City of Fairfax.
11. Accuracy.
The Homevision publishes information on its site as a convenience to our visitors. While The Homevision attempts to provide accurate and timely information, there may be inadvertent technical or factual inaccuracies and typographic errors. The Homevision reserve the right to make corrections and changes to site at any time without notice. The Homevision does not assume any liability or responsibility for the accuracy, completeness, usefulness or reliability of the information access through the site. Visitors assume all responsibility and risk with respect to their use of the site.
12. Violation.
The Homevision reserves the right to remove, destroy or refuse any information or content that violates The Homevision terms and conditions agreement or may otherwise be considered unlawful, indecent, obscene, lewd or objectionable.
13. Damages. IN NO EVENT SHALL The Homevision BE LIABLE FOR ANY DIRECT, SPECIAL, INDIRECT, OR CONSEQUENTIAL DAMAGES, OR ANY OTHER DAMAGES OF WHATEVER KIND RESULTING FROM WHATEVER CAUSE, INCLUDING BUT NOT LIMITED TO LOSS OF USE, LOSS OF PROFITS. LOSS OF DATA, OR ANY OTHER TYPE OF DAMAGE, TANGIBLE, OR INTANGIBLE IN NATURE , WHETHER IN AN ACTION UNDER THEORIES OF CONTRACT, TORT OR OTHERWISE, ARRISING OUT OF OR IN ANY WAY RELATING TO THE USE OR PERFORMANCE OF THE INFORMATION ON, OR ACCESSED THROUGH The Homevision SITE.
14. Price.
Due to market condition all prices are subject to change without prior notice.
15. Credit.
The Homevision has the right to provide a credit on a membership or appointment fee on a case by case basis in the event of typographic errors. However once the appointment is dispatched to the Members its not refundable.
16. Collision.
There are occasions that The Homevision might receive a multiple request from the same Homeowners for different types of projects. The Homevision will sort and dispatch the request with great precision to different Members with no collision among Members. This will create a situation that others might be involved in other projects with the same Homeowners. Please respect their rights as they are respecting yours. You have been referred to this Homeowners to help them with this request only. Please do not get yourself or your friends involve in any other ongoing projects that the Homeowners might have or try to interfere with other Members that might be bidding either on other projects that the Homeowners already started, is going to start or are planning to start in the future. In these circumstances the Members that the lead has been dispatched to, are only there to provide an estimate on that particular request only.
Interfering with other projects and/or other Members might jeopardize your membership agreement with The Homevision. If Members violate other Members right and interfere with a bidding process for other Members the Members at fault will pay for leads that were not dispatched to them, their membership will be terminated, their account will close immediately and they will not be able to open account with The Homevision in the future.
17. Discontinue.
Once a Member have joined the network and have an account activated, but for whatever reason is unable to help any of our Homeowners with their request The Homevision will request the membership to be discontinued and Member's account will close.
18. Authorization:
When you respond to our offer from The Homevision, you agree to the following: a. You authorize us to obtain business and consumer credit bureau reports in connection with your request for an account. If an account is opened, we may obtain credit bureau reports in connection with extensions of credit or the review or collection of your account. If you ask, we will tell you the name and address of each credit bureau which we obtained a report about you. b. If an account is opened, by using the account you agree to the terms and conditions of the agreement. c. You authorize us to allocate your payment and credit in a way that is most favorable to or convenient for us.
19. Individual or Joint Liability:
You understand that by responding to this offer you agree to be personally or jointly responsible for payment of all balances incurred on all accounts issued pursuant to this application now or whenever such additional accounts may be established in the future.
Ownership, Permissions, Submissions and Trademark guidelines:
The Homevision owns the site. The Homevision owns or has the right to all of the logos, icons, marks, characters, artwork, images, graphics, text, forms, applications, price charts, photography, trademarks and other content of the site herein referred to as "Content" and all the HTML, CGI, PHP, SQL, Perl, Apple script, C++, Action script, Javascript and any other code and script herein refer to as "Code" in any format used to implement The Homevision site. The Content and Code of the site are protected by the copyright laws.You may not use, copy, modify, imitate, adapt, disassemble, upload, download, transmit, translate, re-publish, display for redistribution to third parties for commercial or any other purposes, or otherwise distribute any Content or Code from the site without a prior written agreement from The Homevision.Your failure to comply with this legal statement will constitute breach of contract to use the site and will violate The Homevision copyright, trademark and other proprietary rights.
